Renting out your home in Spain as a "seasonal rental"? Important note in the amendment of the law on holiday rentals:
The law regulating temporary rentals includes the amendment of article 2 of the LAU and obliges the landlord to "justify the need for temporary rentals" for temporary rentals, indicating the causes and reasons, the specific circumstances and their relationship with the planned duration. Otherwise, it will be considered a rental contract for the habitual residence.

In other words, in the contract, the landlord must state the reason why the rental is of a "temporary nature". If this is not included in the contract, this contract can be considered a rental contract for habitation with its specific legislation.
